Lunchtime Lecture: Balancing Personal Risk against Personal Reward - The Challenge of Charity Trusteeship
This talk will be given by Kirsty McEwen of Higgs and Sons Solicitors.
Kirsty qualified in 2002 and is an Associate in the Private Client team. She is a specialist charities lawyer who has spent may years advising the charities and not for profit / voluntary sector on all aspects of their operations.
Overview:
Kirsty will talk about the challenges and risks of charity trusteeship and how these can be mitigated.
The lecture will cover:
- The nature of charity
- The general fiduciary and statutory duties owed by charity trustees
- The risk of personal liability and how "structure" can impact on that
- Methods for avoiding, mitigating or managing the risk of personal liability:- i. Legal solutions; ii. Insurance; iii. Relief (statutory or otherwise)
- The increased role of regulation of the Sectore, in particular:- i. The Fundraising Review; ii. The Charities Bill - strengthening the powers of the Charity Commission
