Lunchtime Lecture: Recent vicarious liability Supreme Court case
This talk will be hosted and presented by Chris Gough of Mills & Reeve LLP
Chris is a litigation specialist in the General Insurance team at Mills & Reeve. He deals with high value and complex injury claims. Chris also advises and assists corporate clients who find themselves under investigation by the police and HSE from those same events.
In its decisions in Cox v Ministry of Justice and Mohamud v William Morrisons Plc the Supreme Court has recently given the most explicit guidance to date in relation to vicarious liability. These judgments address (1) who will be classed as an "employee", and (2) how very broadly "work" or the "field of activities" entrusted to the employee, will be determined when deciding whether the employer should compensate. Chris will explore those two judgments, how the goal posts may have moved and how the floodlights (and "floodgates") have certainly been switched on.
Lecture objectives:
- Familiarisation with two leading Supreme Court judgments;
- Awareness of whether and how these decisions have "changed the rules" in deciding vicarious liability of employer;
- Understanding how broadly "employment" can be regarded in modern society and is reflected in these decisions
- Identifying the level and nature of evidence needed to assist in making a robust liability decision in this fluid area of common law;
- Sharpening members' ability to advise Corporate clients in claims review meetings where VL is relevant
