A New Legal Duty - The ‘Protect’ Duty

Overview
A new legal duty - the ‘Protect’ duty - is being introduced following the Manchester Arena bombing. Putting this in place is a government manifesto commitment: “In the wake of the terrible events in Manchester in 2017, we will improve the safety and security of public venues”. The necessary legislation was flagged in the Queen’ Speech in May 2022 and is expected to be scrutinised in Parliament in the next few months.
The duty will apply to operators of venues/places to which the public has access and to organisations of a certain size. It will require assessing, and taking steps to mitigate, the risk of terrorist attacks.

Speaker Bio
Alistair Kinley
Director of Policy & Government Affairs Clyde & Co LLP
Alistair oversees Clyde & Co’s engagement in policy and public affairs with government departments and regulators across the UK and Ireland.
Alistair was a member of the Civil Justice Council of England and Wales (CJC) and worked on the Jackson reforms.
He led activity for Clyde & Co in the European Motor Insurance Directive review and coordinated their implementation of The Insurance Act 2015.
Alistair is an experienced commentator and regular speaker on legal and procedural reform. He is a contributing editor in "The Law Society’s (TLS) Litigation Funding Handbook".
He also edits a chapter in "Bingham & Berrymans' Personal Injury and Motor Claims Cases."
He is a member of the Ogden Tables Working Party. They publish official actuarial tables of multipliers for use in personal injury claims.
