How EL/PL and Products liability can arise in tort, statute and contract

All broking staff should have a clear understanding of how liability can arise if they are to correctly advise their clients.

Liability can arise in three main ways, tort, statute and contract.

Policyholders need to understand their Employers liability, Public liability and Products Liability exposure to tort, statute and contract, so that they can make sure that the cover they are purchasing properly meets their needs. To ensure this happens broking staff must acquire a full understanding of how liability can arise in the three areas of tort, statute and contract and this presentation, delivered by Alan Chandler one of the most popular presenters in the UK, will enable broking staff to achieve this understanding.

Learning objectives

By attending this event, delegates will be able to identify:

  • how an employer can become liable for injuries to their staff.
  • how liability can arise through negligence as well as understanding the statutory obligations of an employer and how these affect liabilities.
  • how an EL policy deals with these liabilities if set up correctly.
  • how an insured can become legally liable for third party injury and property damage and how a public liability policy deals with these liabilities and the problems that could happen if cover is set up incorrectly.
  • how an insured can become legally liable for third party injury and property damage following the supply of products, how the tort of negligence and strict liability under the consumer protection act 1987 affects your clients, and how a products liability policy deals with these liabilities.
  • how contract law can extend liability and why insurers must be advised of any contract that extends liability at law.
