Confronting the UK care system is a daunting reality for many families every year.
LTC qualified advisers are ideally placed to help people through all the aspects of the care system, from local authority “care needs” assessments and the role of the NHS, through to considering all the options for funding care.
Through being qualified and up to date with your knowledge you can make a positive difference, potentially helping thousands of families in a vulnerable position.
In these sessions we shall consider the different aspects of the care market and system, whilst also considering the various ways that care might be funded.
Please note, these sessions will be useful for refreshing LTC knowledge for qualified advisers but equally will help those seeking to get qualified to advise clients. They will each be for about 45 mins to an hour including a Q&A section.
Session 4
Care funding, potential asset deprivation and substituted decision making
Most will not be aware of the potential cost of residential care and once the stress of dealing with the physical care side has been dealt with, the realisation of what it is costing comes to the fore.
Many are very angry as they hadn’t appreciated that social care is means tested and they therefore seek ways to reduce assets available to fund their care. Unfortunately this may be deemed as “deliberate deprivation of assets”
We shall consider what this means and assess what can legitimately be done without contravening the “rules.”
Also, when it comes to advising clients about care funding, in the majority of cases, the adviser will be dealing with a power of attorney acting behalf of the donor and this is quite often the sons and/or daughters where there is potential for conflict of interest.
We shall consider the duties of attorneys when acting on behalf of the donor.
