PI Issues of 2016
1) The Insurance Act: The new regime imposed by the Insurance Act - which marks the biggest shake-up in insurance law since 1900 - comes into force on 16 August this year. With it comes an array of new duties and concepts, each of which gives rise to opportunities and risks. In this talk, we will look at the position from the broker's perspective and will identify where the pitfalls and the possibilities lie. 2) Emerging Risks: The last few years have seen a huge increase in the different types of companies obtaining professional indemnity cover. This brings with it, its own challenges for insured clients, their brokers and insurers. This talk will explore the way in which the insurance industry is adjusting to this 'new class' of business. We will consider particular themes that have emerged and how some of the problems can be resolved. 3) Alternative Dispute Resolution and your Insureds: We have seen an increase in the number of adjudications being pursued against construction professionals - and the solicitors pilot adjudication scheme is now a year old. In this talk, we explore the current Alternative Dispute Resolution landscape and explain some of the different types of ADR that may be available for your insureds and the circumstances in which each might be appropriate Learning objectives Learning about the key provisions of the new regime imposed by the Insurance Act Identifying the risks and the potential rewards for brokers arising from the Insurance Act Exploring some of the emerging risks in professional indemnity insurance with a focus on how to resolve commonly encountered problems Learning about some of the different forms of Alternative Dispute Resolution that exist and how they might affect your insureds. |
