Contributory negligence – have we been too pessimistic?

When defending employers’ liability claims we often assume that we won’t secure a substantial discount for contributory negligence; especially when the employer is significantly at fault. However, the authorities from the last 20 years suggest that the courts take a different view. Following the Enterprise and Regulatory Reform Act (ERRA) 2014, it might now be even easier to convince the court that a claim should be substantially discounted. Should be seize the moment and take a more robust approach?
