Top Ten Personal Injury Cases of 2018
The Insurance and Actuarial Society of Glasgow’s Professional Development Group are happy to announce their next CPD event.
2018 has been another busy year in the Scottish Courts with judgments issued in a wide variety of cases. We have tried to whittle down the decisions issued to produce the “Top 10 of 2018” with a view to providing a brief overview of each case and an analysis of their impact on the Scottish legal landscape.
This 45-minute talk will consider in turn the “Top 10” judgements issued in Scottish Courts this year. It will consider developing trends and include cases dealing with occupier’s liability, employer’s liability, fundamental dishonesty, disease claims and a number of procedural issues including judicial expenses and sanction for counsel as well as cases demonstrating the potential pitfalls of Scottish Court procedure and how they can be avoided.

By attending this event delegates will be able to identify the following:
• The “Top 10” cases issued during 2018 by the Court of Session and Sheriff Courts covering a number of different legal topics.
• The resulting legal landscape and the potential impact of these cases on those working in the insurance industry.
• Lessons that can be learned from the cases covered and the pitfalls to be avoided.
The seminar will be delivered by Lynn Livesey, Associate and Katy Angus, Senior Solicitor at Brodies LLP.
Lynn principally acts for insurers, corporates and public authorities in investigating and defending personal injury actions. She specialises in defending a variety of damages claims including employer’s liability, public liability, road traffic accidents, industrial disease and clinical negligence. She also specialises in the defence of potentially fraudulent claims. She enjoys appearing in the Sheriff Courts throughout Scotland when the opportunity arises.
As a member of the firm’s Health and Safety team, Lynn provides compliance advice to clients. She has investigated several serious fatal accidents resulting in Health and Safety Executive prosecution and has represented clients at fatal accident inquiries and in the defence of such prosecution, including attendance during HSE interviews.
Lynn is a council member of the Insurance and Actuarial Society of Glasgow, and also sits on the Professional Development Group. She is also a representative on 2 Sector Focus Teams for the Forum of Insurance Lawyers.
Katy joined the Insurance & Risk Team in 2018, having completed her traineeship with a firm specialising in defender insurance reparation. She has significant experience of defending a wide variety of insurance litigation matters including public liability and employer liability claims as well as road traffic cases. In addition, she has experience of handling recovery cases on behalf of insurer clients. She has experience of both Sheriff Court and Court of Session actions and has appeared in Sheriff Courts throughout Scotland in a variety of cases.”
