The Insurance Institute of Guernsey is holding a Development Day Morning hosted by Jeff Heasman at Les Cotils on Wednesday, 2nd April 2025.

There have been a number of Court of Appeal and Supreme Court decisions over the past couple of years that have significantly impacted the way that we should be working within insurance and financial services. Recent insurance fraud statistics from various sources have also revealed some very interesting (and in some cases, worrying) trends. Join us on 2 April 2025 for Breakfast at Les Cotils from 8:30 am until 12:30 pm for three sessions delivered by internationally renowned expert and trainer, Jeff Heasman (Insurance Upskill) as we examine these recent court judgments and gain insight into current insurance fraud trends.

Session 1: The “purpose of duty” and a major new approach to professional negligence claims

In Khan v Meadows, the Supreme Court revolutionised the test for negligence in professional indemnity claims. The Court provided guidance on how providers of professional services should be taking steps to mitigate the risk of claims being made against them, as well as looking at how claims will be assessed once made. This session is of critical importance to anyone who offers professional services or works in financial lines.

Session 2: The death of the Orient-Express: a new train of thought on proximate cause?

The law relating to proximate cause has been in constant motion over the past few years with a serious of very important judgments from the Court of Appeal and Supreme Court, especially in relation to concurrent causes. This session will examine these judgments and outline where the law currently stands on proximate cause, along with practical guidance on how we need to adapt underwriting considerations and our approach to claims.

Session 3: Insurance Fraud: what the latest data shows us and what we need to be doing as an industry

Various data and statistics have been released from different sources over the last couple of years and which help to give us an insight in to the current state of insurance fraud in the UK, from ghost broking to application fraud to claims. This session will examine the data and statistics to identify trends and recommend what we need to be doing as an industry in the continued fight against insurance fraud.

Learning Objectives:

By the end of the sessions, participants will be able to:

identify recent Court of Appeal and Supreme Court judgments that affect the insurance and financial services industry.

explain current trends revealed in the most recent fraud statistics.

implement a strategy to respond to recent court judgments and fraud statistics.

The session provides for 3.5 hours of CPD.

The Insurance Institute of Guernsey is in the fortunate position of being able to subsidise this event, and the fee for attending is £55 per person.
