(GI) CPD Webinar - BI insurance and covid-19: the supreme court’s decision in The Financial Conduct Authority v Arch insurance (UK) Ltd & others
Overview:
Businesses and Insurers have been eagerly awaiting the Supreme Court’s decision on whether a variety of BI policies cover losses resulting from the COVID-19 pandemic. On 15 January 2021 the Supreme Court dismissed insurers’ appeals and substantially upheld the FCA’s arguments on behalf of policyholders. This webinar is of general topical interest as so many businesses have suffered due to COVID-19 and the measures that the Government and public authorities have taken in response to the pandemic. This talk will be of particular value to those who handle BI claims, as well as those who broke or underwrite such insurance. Alison will highlight some of the main legal issues and how they have been addressed by the Supreme Court
Learning objectives:
By attending this webinar, delegates will be able to appreciate:
- The way that the Supreme Court has interpreted sample BI wordings
- Issues that arise in causation of such BI claims, particularly when seeking to prove or rebut them
- How the trends clauses should operate in relation to the calculation of BI losses
- How BI policies and claims may be dealt with following this decision
