Event Overview
This session will provide an overview of the Compulsory Motor Insurance Regime and how Insurers' obligations are affected by any breach of condition or misrepresentation / non-disclosure on the part of a policyholder.
Learning objectives
By the end of the session the delegate will be able to:
1. Understand the Compulsory Motor Insurance Regime and the layers of contractual / compulsory motor insurance;
2. Consider how insurers' obligations towards the policyholder and third parties differ under each layer of insurance;
3. Explore the circumstances in which insurers may be able to avoid liability for claims;
4. Identify the key practical steps and time limits involved in cancelling / avoiding a policy of insurance;
5. Acknowledge the effect of the CJEU Vnuk decision and potential changes to Compulsory Motor Insurance in the near future
Speaker profile
Amy is a Technical Director within the Commercial Insurance team at DWF dealing with a wide variety of complex insurance disputes and policy coverage issues and is regularly instructed by insurers in relation to motor insurance, Road Traffic Act and MIB issues. Amy has a longstanding specialist interest and experience in agriculture and animal related claims including the application of cover (whether EL, PL or Motor) to claims involving animals. Amy is deputy head of the DWF Equine team.
Charlie is a Solicitor within the Commercial Insurance Team at DWF who deals with a range of complex claims on behalf of the UK's leading Insurers. Charlie also has extensive experience of advising insurers on indemnity issues arising in motor, EL and PL policies, and assists with the team's Motor Prosecution Unit advising and representing policyholders during investigations and proceedings arising out of Road Traffic Offences.
