Overview
Surveillance has been a longstanding tool for insurers to challenge exaggerated and fraudulent injury claims. Done properly it gives a clear insight into the true level of restriction suffered by a claimant and can provide irrefutable evidence of exaggeration.
Over the last 20 plus years, there have been significant changes to controlling legislations as well as insurer, legal and public perception of investigators and surveillance as a whole. However, in the advent of the Fundamental Dishonesty argument at trial, surveillance evidence is arguably more powerful than ever.
An increase in contempt of court proceedings and criminal prosecution following successful Fundamental Dishonesty arguments has also led to stronger challenges and increased scrutiny of surveillance evidence, reinforcing the importance of ethical and lawful observation as well as careful handling of the evidence obtained.
In this webinar, Ben Robertson of Robertson & Co will discuss the legal and ethical restrictions of surveillance and how surveillance should be undertaken to avoid potential reputational damage to insurers as result of bad practice. He will also highlight the increased challenge to evidence from claimant solicitors and how to ensure that attempts to discredit surveillance footage are easily countered.

About Ben Robertson
Ben has been involved in Insurance Investigation and Personal Injury surveillance for 22 years, having formed Robertson & Co. in 1998 with his father. Ben has significant experience of surveillance, having worked extensively in the field undertaking physical surveillance for a number of years before manging the Surveillance Department and later taking on the role of Managing Director of Robertson & Co.
