Clarifying which insurance policy responds (CAR/Liab/PI)

Stephen Tester will outline his experience of handling large losses on construction and engineering projects which have the potential to trigger multiple policies of insurance.
In this lecture, Stephen will explore the complex issues that can arise when a loss occurs which has the potential to involve multiple parties to a project and where many, potentially overlapping, policies of insurance might be brought into play. These cases usually involve many stakeholders, each with different interests in the resolution of the various liability and coverage issues. Stephen’s lecture will tease out the various legal points that can arise in these cases, show how they have been resolved in the past and draw conclusions as to how the interests of the various parties might be reconciled in future cases.
By the end of this lecture members would have gained an insight into:
- the legal and contractual issues that can arise when large losses are suffered in construction and engineering contracts, and
- how these might be resolved in future cases.
