Event Overview
People don't get paid to do their jobs wrongly, never mind negligently or even recklessly. Time and effort goes into careful recruitment, induction, training and supervision. And then it can still go wrong. Sometimes even "criminally" wrong. In the space of a lunchtime session Chris Gough will explore and refresh some of the principles underpinning the employer's liability for the actions/inactions of its workforce. Chris will explore the furthest boundary of this sometimes overlooked concept, and the factors that can raise a duty on employer for criminal actions undertaken in the course of the working day.
Learning objectives
By the end of the session, delegates will be able to:

Describe the concept of vicarious liability and its emergence as a legal principle

Reflect on the circumstances in which the fact of "employment" should realistically be dispute

Consider the principles that help determine that "fact of employment"

Assess how far those principles can be stretched by the court to establish a "duty of care" and a route to compensation even for the most violent of actions.
Speaker Profile
Chris is a litigation specialist within the insurance disputes practise at Mills & Reeve, resolving complex and high value injury and property claims, usually acting for insurers or directly for corporate clients who have a direct financial interest in their claims experience. Chris also protects businesses and individuals facing investigation by the police or HSE, helping them avoid or minimise any regulatory sanction. Chris is an active member of The Chartered Insurance Institute and the Institute of Occupational Safety and Health, providing training and other support, particularly to the North West local insurance institutes.
