PFS Chartered Connections Event
The session will look at essential business planning from the corporate POV and from a private client stance; covering business continuation on loss of capacity and death and mitigating inheritance tax via gifts, reliefs and effective will planning.
Learning Objectives
- The importance of a strong governance framework with regards to succession planning;
- Ensuring there is a robust succession plan in place regarding the governance of the business, whether in the short term or longer term;
- The importance of memorandums, articles and shareholders agreements dovetail with your Will;
- The effective use of gifts, keeping in mind IHT relievable assets, CGT and entrepreneurs relief;
- Cross-option schemes;
- Using different share classes to retain control, but give away equity;
- How to maximise availability of BPR or APR during ownership;
- How to best use trusts in Wills to keep business assets together moving from generation to generation;
- The importance of crystallising BPR on the first death;
- The use of double dip wills – how to gain maximum IHT relief when there is a split between relievable and non relievable property;
- The importance of having LPA’s in place and having a separate business LPA.
Speaker Bio's
Jan Pointer – Associate solicitor in the Private Client team. Deals succession planning, probate and trust work. Is also a member of the Family Owned Business team at Birketts and is currently undertaking STEP qualifications in Trust and Estate Planning.
Greg Allan – Partner in the Corporate team. Greg has been involved in numerous acquisitions, mergers, MBO's and disposals acting for vendors, buyers and financial institutions. He deals with business restructuring and is also a member of the Family Owned Business team.
