Insurance Act Mock Trial A Huge Success

The trial was set in a post Insurance Act world and will focused on the new Duty of Fair Presentation and how it differs from the current disclosure obligations, changes to warranties and how those changes may impact on claims in practice.

Members of the local insurance community got the chance to see Barristers from Ropewalk Chambers in action questioning both a broker and an underwriter as part of a mock trial around a Cyber Policy for which a claim had been repudiated.

Browne Jacobson gave everyone in attendance an insight in to what happens when things go wrong and hopefully how we can all avoid these pitfalls.

Attendees got a chance to vote on the outcome of the trial and if they thought what had been was put forwards was a fair presentation, if not had this been reckless and then the likely actions by the insurance company involved.

An excellent question and answer session after the main trail with the barristers, solicitors, expert witnesses and insurers let local brokers ask some pressing questions.

The feedback from the sell out event was all very positive and NII would like to give our thanks to everyone involved.

I attended the mock trial yesterday and it was excellent. The setting really worked and it was interesting to hear the barristers thoughts on the insurance Act.
