Insurer insolvencies and FCA guidance on due diligence

This session will be of interest to any CII member but of particular relevance to insurance brokers

This session will consider the increased risk of insurer insolvencies and the impact for brokers.

In particular we will focus on the FCA’s mandatory guidelines for brokers recommending unrated insurers and a look at the recommended due diligence.

Learning Objectives:

Attendees will gain a clear understanding of the risks of recommending unrated insurers to clients and the steps the FCA require brokers to undertake before doing so.

A light buffet lunch and refreshments will be available from 12.15 with the seminar starting at 1p.m. for an hour.

Neil Frankland - Partner Mills and Reeve

Neil is an expert in defending claims against those working in both the construction industry and insurance brokers. He is known for his hard work, determination and innovative approach to getting results.

With brokers, Neil has led a team in developing a market leading "helpline" approach to the triage of claims at an early stage and as a consequence helps avoid issues becoming more expensive problems.

James Thompson – Principal Associate Mills and Reeve

James is a principal associate in our insurance disputes team, acting for professional indemnity insurers and their professional insureds. He advises insurers in relation a wide range of policy coverage matters. James also acts in the defence of a variety of professions including insurance brokers, lawyers and financial professionals. He has significant experience of litigation, arbitration and alternative dispute resolution.

James regularly works with insurance brokers and their insurers to challenge adverse policy decisions made by insurers, including advice on the application of the proportionate remedies provided by the Insurance Act 2015.
