Senior Managers and Certification Regime – what needs to be done by 9th December 2019
A briefing from Branko Bjelobaba FCII, FCA Compliance Consultant and CII Accredited Advanced General Insurance Trainer. This event is of relevance to general insurance intermediaries, IFAs and mortgage brokers. In response to the 2008 banking crisis and significant conduct failings such as the manipulation of LIBOR, Parliament set up the Parliamentary Commission for Banking Standards (PCBS) to recommend how to improve standards in the banking sector. PCBS recommended a new accountability framework focused on senior management. It also recommended that firms take more responsibility for employees being fit and proper, and that there be better standards of conduct at all levels in banking firms.

Vulnerable Customers
The FCA have found following a thematic review that vulnerable customers are often not treated fairly. In fact many Insurers pricing models have taken significant advantage of these customers, often the more vulnerable the customer the more the insurer has loaded rates at renewal. The Independent Contractor Test Is Dead & Vicarious Liability Is On The Move
The Court of Appeal decision in Barclays Bank Plc v Various Claimants on 28 June 2018 has caused concern across the insurance industry, with the court signalling the independent contractor test is now dead. There has in fact been a recent spate of decisions in the Court of Appeal and Supreme Court that have caused serious concern in the insurance industry. However, the decision of the Supreme Court on 25 July 2018 in James-Bowen & Others v Commissioner of Police of the Metropolis may be the much-needed calm after the storm.
