November CPD
Details
This event will be presented by John Habergham who is a specialist Insurance Contract Lawyer (especially Transportation) with Myton Law. John is a former Chairman of the Leeds Marine Insurance Association and guided them through the Law Commission proposals leading up to implementation of the Act. The event will:
- recap the main changes, the most significant in a century
- look at the more recently introduced issue of damages for late payment
- also focus on the practical outcomes that have occurred over the last 12 months and the pitfalls that have been experienced by both Insurers and Brokers in both underwriting and claims handling practices including the implications for Insurers and Brokers of contracting out
We hope this will be a very interactive session where the experiences of those present can be discussed and practical solutions suggested.
Why you should attend this event:
This is the most significant change to Insurance Law in several generations and the impact of it is evolving quickly. Anyone who fails to grasp the implications and just carries on as before is at risk of at best falling foul of good practice and at worst being open to legal redress.
Who should attend?:
This will be of interest to General Insurance Brokers, Insurers and Loss Adjusters – particularly those involved in the claims process and problematic claims. However it will also be of interest to all customer-facing broker staff and Underwriters – who are often asked to interpret the meaning of the Policy Wordings they have issued and their ‘intentions’ as applied to circumstances that might not have quite been foreseen!
Learning Outcomes:
After the event you will have
- an increased awareness of both Insurers professional duties and responsibilities brought about by the Act.
- an increased understanding of some of the practical issues that have arisen following introduction of the Act.
- reinforced your knowledge of the disclosure regime, the change effect of warranties, the implications of contracting out and new issues around damages for late payment.
- practical solutions for actions that need to be reinforced within your own business practices.
