Two recent Acts (the Insurance Act 2015 and the Enterprise Act 2016) were expected to fundamentally changed the legal framework of commercial insurance placement in the UK. But what difference has this legislation actually had so far?

Learning Objectives
By the end of the seminar, delegates will:

  • know how the market has reacted to the Insurance Act in the first year after its introduction

  • understand the key issues which the Insurance Act and Enterprise Act are affecting, including
    - how the 'duty of fair presentation' is being managed by the industry
    - the drivers behind the increased advisory burden on brokers, including advising on 'fair presentation' and identifying and managing 'contracting out'
    - the impact on claims disputes including the increased importance of post-loss conditions and terms which define the risk as a whole
    - what a customer would need to do to bring a damages claim under the Enterprise Act legislation

  • have greater confidence in developing plans to navigate these changes within their teams/day to day activities
